Oak Bay police have determined that an unlicensed 23-year-old man was behind the wheel of a speeding vehicle that hit a tree June 18 — not the 20-year-old woman who had said she was driving.

Police said they will be recommending criminal charges of obstruction and dangerous driving for the incident, which saw a Ford Mustang being clocked at 73 kilometres an hour in a 40 km/h zone. The car then ran into the tree about 350 metres away on Beach Drive.

The obstruction charge stems from the real driver claiming he was a passenger. Police said he had been drinking but wasn’t tested because of his claim.

The crash drew considerable attention because of the stickers that were on car. They included: “Street racing is not a crime” and “Yes officer I did see the speed limit sign (I just didn’t see you).”

ICBC, which can deny the accused coverage, has been notified.

One of the three passengers in the Mustang was sent to hospital with a possible vertebrae injury and later released.
