DOS files legal papers against trucking company

The District of Squamish has filed suit in B.C. Supreme Court against a local company whose lease on municipally-owned land has expired.

JR Transport was supposed to be off District of Squamish (DOS) owned land at Loggers Lane on the Mamquam Blind Channel by the end of last month but the company is still on the land. A lease agreement JR Transport had with the DOS expired before the company owner could secure a new location for his trucking company.

The DOS wants to turn the JR Transport site into a parking lot. As another step toward getting the company off the land the DOS filed a writ of summons with the BC Supreme Court on March 11 following a Mar. 1 in-camera directive from council.

According to the lawsuit, the DOS wants the courts to declare JR Transport is a trespasser on the DOS land. The DOS also asked for "an injunction requiring JR Transport to immediately provide the district with full and vacant possession of the lands."

The DOS wants the courts to reiterate previous demands that JR Transport remove the equipment and its building from the lands and then remove any contaminants.

The DOS wants a second injunction restraining JR Transport from unlawfully occupying the lands.

The DOS is also seeking damages, costs and anything else the courts might find appropriate.

Darren Doak of JR Transport said he filed a statement of defense but chose not to say anything beyond that because the matter is now before the courts.

As of The Chief's press deadline, the land in question was still occupied by JR Trucking.
